Triumphantly Coping With Challenges of FUTURE

To triumphantly cope with challenges of the future, USAmerica must adopt a new U.S. Constitution for 21st Century and Beyond.  The proposed Constitution offers realistic, visionary goals, and objectives for the future.

The Preamble reads:
"WE, the PEOPLE...do hereby declare and affirm our will and desire to establish a new Constitution for the United States of America.
Our noble purposes include, but are not limited to, the following objectives:

  • To restore Government of, by, and for the PEOPLE....
  • To inaugurate a new system of values under which advancement of the status of all citizens ranks as highest priority
  • To strengthen and accelerate economic progress through enterprise systems and a market economy to facilitate and expedite production of products and services for fulfillment of needs of the people and economic progress
  • To create a national defense and security system capable of coping with challenges of 21st century
  • To strengthen the system of law, equity, and justice to establish an environment of security and to preserve order, stability, and peace
  • To prudently, efficiently, effectively, and equitably manage, develop, distribute, utilize, and replenish our natural resources
  • To accelerate scientific and technological progress and provide for development and equitable distribution of benefits among citizens
  • To protect, preserve, and enhance our environment for benefit of contemporary and future generations
  • To recognize, protect, and preserve fundamental Human Rights for all citizens in equal measure in a self-governing society
  • To design a foreign policy of cooperation with other Nations in development of effective international law for universal progress, security and peace on Planet Earth
  • To explore, develop, and equitably utilize benefits of extraterrestrial space and outer universe for peaceful, non-aggressive purposes...
  • To attain such other common purposes, aspirations, and goals of a self-governing people as necessary for freedom and democracy"

Abraham Lincoln in the 1860's era of turmoil amid the Civil War stated:
"The dogmas of the quiet past are inadequate to the stormy present….  As our case is new, so must we think  and act anew…."

So it is with our nation facing the challenges of the 21st century.

CITIZEN RIGHTS, OBLIGATIONS, and REWARDS

Under the proposed Constitution, Article VIII, Citizen Rights, Obligations, and Rewards reads:
"…privileges, opportunities, and other values of citizenship shall not exist as "free rights"; but, rather, shall be merited by fulfillment of duties, obligations, and responsibilities of citizenship."

OATH of ALLEGIANCE
To merit endowment, protection and preservation of rights, all citizens--native born and naturalized--shall affirm, by signature, the following oath:

I, (citizen name), do hereby solemnly pledge, to the best of my ability and without reservation, to perform all obligations and responsibilities of citizenship including, but not limited to, the following DUTIES:

  • To protect, preserve, and defend the letter, spirit, and principles of the Constitution
  • To obey laws
  • To vote in elections
  • To proportionately support the Constitution, Government, laws and policies with contributions to a fair, equitable tax or other revenue system
  • To respect--and refrain from infringement of--rights, interests, and privileges of other citizens
  • To refrain from lawlessness, corruption, subversion, rebellion, crimes, and other acts that violate peace, integrity, tranquility, security, and sanctity of other persons, properties, institutions, and the nation
  • To join and/or support national forces mobilized to defend the nation and its citizens against aggression threatening peace and freedom of the nation; and/or to perform alternative service in support of commonly-established goals of the nation as defined by the Congress

To these ends, I pledge/dedicate my faithful devotion, assets, work, and life.

Covered in the Oath of Allegiance, violation(s) of law(s) will result in prosecution not only for crime, but also for perjury.

CITIZEN SERVICE to NATION
Upon attainment of the legal age of adult status of 18 years (or other age established for adulthood by amendment of the Constitution), all citizens (1) shall have been educated to the principles, laws, and duties relating to citizenship in the nation; and (2) shall be required to perform national service, either military or non-military: 

  • One (1) year normal, peaceful time
  • Two (2) years or more in national emergency
GOLDEN CHRONICLE of CITIZEN RIGHTS

Under the new Constitution, a Golden Chronicle of Citizen Rights--replacing the old Bill of Rights--promulgates endowments, privileges, and opportunities including, but not limited to, the following RIGHTS:

I.  FREEDOM
All citizens shall enjoy maximum freedom within disciplines necessary to protect rights and interests of all people within an orderly, peaceful society.

II.  DEMOCRACY
All citizens shall enjoy the right to a "voice" in government including:

  • A right to vote in secret ballot to select--and elect--representatives to carry out the will of the people through government by consent of the governed
  • A right to vote in National Referendum for direct lawmaking by citizens
  • A right to vote for recall of representatives for failure to effectively and faithfully carry out the will of the people in government; and
  • A right to vote for such other values and objectives necessary to establish and protect freedom and democracy

III.  ADVANCEMENT of STATUS of CITIZENS
All citizens shall enjoy the highest quality of life that the nation can endow, including benefit from programs providing necessities of food, housing, health and medical care, education, and other values, as well as acceptable standards of living.

IV.  RIGHT to OWN PROPERTY
All citizens shall enjoy the right to own property and other entities of value.Citizens shall have the right to retain protective devices, including firearms, for defense of property and life.  Firearms or other protective devices shall be duly registered with a responsible public authority.  Firepower or other force of such weapons or devices shall be prescribed by law and shall not exceed power or force considered necessary for protection of property and life.

V.  FREEDOM to COMMUNICATE
All citizens shall enjoy the right to speak, write, broadcast, telecast, and otherwise communicate with other citizens, as well as the Government, on political, economic, judicial, religious and other subjects, theories, and concepts, within safeguards necessary to protect rights, integrity, and interests of all citizens and the nation.

VI.  FREEDOM of ASSEMBLY
All citizens shall enjoy the right to peacefully assemble, to engage in discussions, and to study, assess, or otherwise relate to and evaluate political, religious, ideological, or other subjects, theories, and concepts without fear of prosecution, within safeguards necessary for protection of rights of citizens, the common good, and security of the nation and its people.

VII.  EQUAL STATUS UNDER LAW
All citizens shall enjoy the right to equal status under law without regard to race, creed, nationality, ethnic origin, gender, ideology, religion, economic status or other factor or value.

VIII.  PROTECTION by DUE PROCESS of LAW
All citizens shall enjoy the right to due process of law; and, in event of detainment, arrest, and/or prosecution, to a fair, speedy trial by qualified, justly-selected jurors.

IX.  SAFEGUARDING PRIVATE LIFE
All citizens shall be protected against unwarranted or unreasonable search, seizure, or invasion of domicile, person, papers, or other effects or properties by external forces, or by police or other officers of the nation, without due process of law.

X.  PROTECTION AGAINST EXPLOITATION and ECONOMIC SERVITUDE
All citizens shall be protected against exploitation, economic servitude, and other harmful or degrading conditions imposed directly or indirectly (a) by persons, organizations, or institutions; (b) by usurpation of powers and instruments of Government by political, economic, military, or other forces within a nation; and/or (c) by the Government itself.

XI.  PROTECTION AGAINST DISCRIMINATION
All citizens shall be protected against discrimination related to voting, employment, access to public facilities, and other publicly-endowed privileges, human rights, and common values without regard to race, gender, age, religion, or other factor or value.  Upon proof of guilt, perpetrators of discrimination shall be prosecuted in accordance with penalties to be established by law.

XII.  RELIGION and CULTURE
All citizens shall enjoy the right to worship a God(s), or to pay homage to other religious, cultural, or revered value(s); or the right to refrain from such homage.

XIII.  GRIEVANCES
All citizens shall enjoy the right to petition the Government for redress of grievances.  Petitioning the Government, however, shall not include use of money, political power, or other values, forces, or influences for bribery, extortion, or other influence relating to votes, decisions, or other acts by officers of Government.  Mandatory penalties shall be established for  influence peddlers, officers of Government and all other persons or interests involved in any malpractice of undue influence upon officers and employees of the Government.

XIV.  SHARING of RESOURCES
All citizens shall enjoy the right and opportunity to share proportionately, or appropriately, in values, wealth, properties, and other resources of common property of the nation, with equal opportunity for proportionate access to, and benefit from, all common public facilities, assets, values, and other benefits inherent in, or provided by, the nation.

XV.  SEPARATION of RELIGION and GOVERNMENT
Religion(s) and Government shall coexist as separately-operating entities of the nation but independent in status; except that religious activities involving accrual of inordinate property and economic values and wealthshall be subject to audit by the Government.  Upon determination that more than 10% of income, assets, wealth, and other accrued values have been utilized for non-religious, non-humanitarian, non-charitable purposes--including accruing assets, wealth, and other values for leaders and members of religions, cults, or other groups: these shall be subject to taxation by the nation.

XVI.  HUMAN RIGHTS shall be recognized, protected, and preserved for all citizens.

XVII.  TRUTH in PUBLIC COMMUNICATIONS
All citizens shall enjoy the right of free speech of truth relating to freedom, law, justice, human rights, and all valid subjects of public discourse. Public communication and dissemination of disinformation, untruths, half-truths, and lies to citizens and the nation, however, shall be prohibited (1) by Presidents, Members of Congress, other officers of the Government, candidates for public office, and other citizens; and (2) by non-government political, economic, religious, and other individuals and organizations not validated by evidence, fact, logic, and other valid measurement of truth.

XVIII.  GENERAL RIGHTS and PRIVILEGES
All citizens shall enjoy a right to access, and benefit from, other values, privileges, and opportunities not identified herein, or designated elsewhere, but not prohibited by the nation and political subdivisions under the Constitution. The Federal Government, states, and political subdivisions shall not prohibit, or infringe upon, rights herein prescribed except as resulting from crime, violation of law, or other invalid act as determined by due process of law.

Values…of a New CONSTITUTION

Under the proposed U.S. Constitution for 21st Century and Beyond, the GOAL will be to institute REAL DEMOCRACY for effective government by consent ofthe governed in the United States of America.

Major principles, objectives, and values of the new Constitution include:

  • Voice of VOTER-CITIZENS--not of POLITICAL and ECONOMIC POWERS--will be the dominant authority in managing national affairs and determining national destiny.
  • Candidates for PRESIDENT will be ELECTED directly by voter-citizens--NOT nominated by corrupt political parties controlled by BIG MONEY and elected by an anti-Democracy Electoral College selected by State Legislatures.
  • Candidates for VICE PRESIDENT will be  ELECTED directly by voter-citizens--NOT dictatorially selected by the Presidential candidate hand-picked by big-money-controlled political parties.
  • MEMBERS of CONGRESS will be elected directly by VOTERS--NOT selected and nominated by BIG MONEY-dominated, obstructive to Democracy POLITICAL PARTIES--cesspools of corruption, anti-Americanism, and betrayal.
  • Presidents, Members of Congress, and other officers and employees of Government will be required to be elected, or appointed, based on KNOWLEDGE and EXPERIENCE--not on political considerations.
  • POLITICIANS will be PROHIBITED from "selling votes" to solicit money for political campaigns--subsequently betraying citizens and the nation by serving big-money donors.  Under the new Constitution, such acts will be treason and punishable by imprisonment or loss of citizenship and exile.
  • New, fair TAX LAWS will be adopted by citizens in National Referendum for a fair and equitable distribution of the burden on taxpaying citizens to support accelerated economic progress.
  • New MONETARY POLICY will be adopted by citizens in National Referendum to equitably finance the well-being and advancement--not extortion and enslavement--of citizens and the nation.
  • NATIONAL RESOURCES will be more effectively managed to advance quality of life for citizens and nation--not "given away" to corporations, banking, and wealthy, or to special interests such as mining companies, lumber industry, cattle industry, tourism, and other businesses.
  • A new National Judicial System for Law and Justice will provide stronger law, order, safety and security for citizens, including equal justice under law for all citizens--not now existent.
  • High priority will be accorded expansion of opportunities for citizens for employment, housing, food and nutrition, education, health and medical care, other aspects of physical, intellectual, and material advancement.  This will include a safety net for less advantaged and those stricken by adversity
  • Necessary improvements will be made in the long-neglected national infrastructure:  highways, waterways, transportation systems, mass transit, harbors, airports, bridges, and other publicly utilized systems.
  • Safeguards will be instituted for more effective protection, preservation, and utilization of the national environment.
  • National priorities will be reoriented away from massive expenditures for military systems, war and killing and toward (a) improving the quality of life for citizens and (b) for promoting PEACE in the world.
  • Direct Democracy by National Referendum will offer CITIZENS greater opportunity to resolve problems and shape national policy, including a dominant "Voice" on taxation, monetary policy, fiscal policy, management of national resources, determinations of peace or war, and other high priority challenges.
  • Citizens will be endowed with the opportunity to participate in visionary planning for determining our national destiny for the future.

Vision of... THOMAS JEFFERSON

Is advocating a new Constitution radical?  Remember that the author of the Declaration of Independence, Thomas Jefferson, reportedly stated that it might be advisable to consider changing the Constitution with each new generation--not at more than 200-year intervals--to meet needs and challenges of changing conditions, events, and times.

Thomas Jefferson also stated that his objective in the Declaration of Independence was:
"…to place before mankind common sense…so plain as to command assent…."

So it is with the proposed U.S. Constitution for 21st Century and Beyond:
"…to place before citizens evidence, logic, reason, and common sense so plain as to justify adoption of the new Constitution by voter-citizens for the United States of America."

A new standard of TRUTH in PUBLIC COMMUNICATIONS will protect citizens and the nation against un-truths, half-truths, and damned lies by political candidates or officers of the Government.

 

VALUES of a new Constitution include:

  • Stronger "Voice" of Citizens in national policies
  • Knowledge qualifications standards for Presidents and Members of Congress
  • Fair tax laws
  • Balanced Federal Budget
  • Prohibition of bribery of politicians
